This Indenture made the 15th day of April in the year of our [Lord] one thousand seven hundred & eighty between Abraham Smyth and John Johnston both of Antrim Township in the County of Cumberland & State of Pennsylvania executors to the last will and testament of William Smith deceased of the one part and John Patterson of Washington Township in the County and State aforsd. of the other part

Whereas Wm. Smith of Peters Township deceased did appoint the above named Abm. Smith and John Johnston excrs. and James McDowell and Matthew Willson Guardian to his last will and testament and did by his last will and testament order several tracts of land to be sold and disposed of at their discretion amongst which is a certain tract described in the will thus: a tract of land in the forks of the Yough & Monongehela called the Mill Seat adjoining Maurice Bready as by reference to the aforesaid last will and testament will appear

Now this Indenture Witnesseth that for and in consideration of the sum of four thousand pounds continental currency to the aforsd. Abm. Smith and John Johnston in hand paid by the aforesaid John Patterson before the sealing and delivery of these presents the receipt whereof is hereby acknowledged and the said John Patterson his heirs and assigns forever discharged from the same they the aforesaid Abm. Smith and John Johnston hath granted bargained sold released and confirmed and by these presents doth grant bargain sell release and confirm unto the sd. John Patterson his heirs and assigns all that tract of land situate in the forks of Yough as before recited containing three hundred and twelve acres & usual allowance of six acres [sic] per cent for roads &c. Together with all and singular the improvements rights members hereditaments & appurtenances thereon or thereunto belonging or in any wise appertaining and the reversions & the remainders rents issues & profits thereof Together with all the right title interest property and claim which the said William Smith deceased had in and to the same To have and to hold the aforsd. tract of land or plantation containing three hundred twelve acres & allowance of six per ct &c and premises hereby granted mentioned or intended so to be with the appurtenances unto the sd. John Patterson his heirs and assigns forever subject to the payment of the purchase money interest and quit rents which may now be due on the same or to become due to the Proprietors of Pennsylvania their heirs and successors and the aforsd. Abm. Smith & John Johnston for themselves their heirs exrs and admrs and for every of them doth covenant promise grant and agree to and with the the said John Patterson his heirs and assigns by these presents that the afirsd tract of land of three hundred and twelve acres and the appurtenances they will warrant and defend unto him the said John Patterson his heirs and assigns from and againstthem the said Abm. Smith & John Johnston and their heirs and against all other persons whatsoever claiming or that shall or may hereafter claim the same by or under them or any of them lawfully

Wilson came before me one of the Justices of the County afsd. and acknowledged the within Instrument of writing to be their act and deed for the use therein mentioned and the same to be recorded Given under my hand and seal this 2d. day of May A.D. 1780

Westmoreland Co SS: I do assign all my right and title claim and interest of a certain tract of land as described in this Indenture for the consideration of one hundred and fifty bushels of wheat, fifty bushell paid on demand fifty to be paid on the 21st Novr. 1781 and fifty to be paid Novr. 21st 1782 also one thousand pounds to be paid to Mary Smith in one year after the date herein mentioned. Came before me the subscriber one of the Justices of the Peace for Westmoreland County William Latta and acknowledged this to be his act and deed.
